1.     ENTRY:

 

There are two ways to enter: (a) go to www.nhl.com/nextel and fill out all of the required fields for a chance to win prize from Nextel and the National Hockey League, or (b) Mail completed entry form or plain 3Óx5Ó paper with hand-printed name, address, day and evening telephone numbers and date of birth to 2003 Nextel/NHL All Star Sweepstakes Featuring Olie Kolzig, c/o Octagon, 1266 East Main Street, 7th Floor, Stamford, CT 06902 to win a prize from Nextel and the National Hockey League. While sweepstakes entrants are encouraged to play the NEXTEL / NHL ALL-STAR CHALLENGE online contest (ÒContestÓ), participation in the Contest is not required in order to enter the sweepstakes. Limit of one entry per person and/or email address regardless of the method of entry. Any person who enters using multiple e-mail addresses will be disqualified from participation for the remainder of the promotion. Online entries will be deemed to have been made by the registered holder of an e-mail account.

 

Nextel Operations, Inc., a Delaware corporation, d/b/a Nextel Communications (ÒSponsorÓ or ÒNextelÓ) the National Hockey League and its member teams, NHL Enterprises L.P., NHL Enterprises Canada, L.P., NHL Enterprises BV, NHL Interactive CyberEnterprises LLC, Octagon, Inc. and each of their respective shareholders, employees, parents, directors, officers, affiliates, representatives, agents, successors, and their related companies, agencies, distributors, sponsors and all prize suppliers/participants (collectively called ÒCompaniesÓ) are not responsible for late, lost, illegible, damaged, stolen, incomplete or misdirected mail or entries, any viruses transmitted to computers of participants via the internet, or for any technical or human errors associated with the sweepstakes. The Companies are not responsible for typographical or other errors in the offer or administration of this contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of winner, or the distribution of any prize. If any activity relating to any prize is canceled or postponed for any reason, the balance of that prize will be awarded in full satisfaction of prize award. No photocopies, facsimiles, or other mechanical reproductions of entries will be accepted. Altered, defaced, mutilated, illegible, or incomplete entries are ineligible. Upon submission, all entries will become the property of Sponsor and will not be returned. By opting in to receive additional information from Nextel, entrants acknowledge that entry information may be shared with promotional partners and retailers without notice and compensation.

 

2.     TIMING:

 

Sweepstakes begins on October 9, 2003. All entries must be received by 11:59 p.m. Eastern Standard Time on January 9, 2004.

 

3.     PRIZE:

 

One (1) grand prize winner will receive a trip for two (2) to the NHL All-Star Game in St. Paul, MN, including round-trip, coach class airfare as selected by Sponsor to and from the major commercial airport nearest the winnerÕs home to the major commercial airport nearest the venue, ground transportation to and from airport, hotel, and game venue(s), three (3) nights hotel accommodations for two (2) (based on double occupancy and selected by Sponsor), two (2) tickets to the NHL All-Star Game, the YoungStars and SuperSkills Competitions, the All-Star Morning Practice; Approximate Retail Value (ARV) is $2,500. Airline tickets subject to blackouts and restrictions. Game and competition ticket locations and value subject to availability. All taxes, charges and other expenses not expressly listed in these rules as being part of the prizes are the sole responsibility of the winners. Winner must be available for travel during the week of the NHL All-Star Game (February 6-8, 2004), or the prize will be forfeited and an alternate winner selected.

 

The Grand Prize will be awarded via a random drawing which shall be conducted by an independent judging organization whose decisions are final on all sweepstakes matters. Prize drawing will be conducted on or about January 14, 2004. Odds of winning depend on the number of eligible entries received. Attempts to notify the winner will be made by e-mail and/or telephone. If any prize winner cannot be reached within five (5) days, or if a potential prize winner is ineligible or fails to complete required documentation within time required, then the prize will be forfeited and an alternate winner selected.

 

 

4.     ELIGIBILITY:

 

Open to legal residents of the US, who are at least 18 years of age at the time of entry, excluding residents of Rhode Island, Puerto Rico and all other US Territories and possessions. Void where prohibited or restricted. Offer subject to all applicable laws. Employees of the Companies, or their immediate family members or persons they are domiciled with, are not eligible to participate.

 

5. GENERAL CONDITIONS:

 

By participating, entrants agree (a) to abide by these Official Rules and the decisions of the Sponsor and judges, which will be binding and final in all respects; (b) to CompaniesÕ use of information supplied by entrants who opt in for marketing and advertising purposes as allowed by law; (c) to indemnify, defend and hold harmless Companies, their officers, directors and employees from any and all liability, claims, law suits, costs, expenses, fees, injuries, (including death), losses, and damages resulting from participation in the sweepstakes, acceptance or use of any Prize, and/or from entrantÕs fraudulent or otherwise wrongful acts or omissions; (d) not to sue Companies for any damages arising from winnerÕs acceptance of or use of the Prize or for damages to entrantsÕ hardware or software resulting from the online participation in the sweepstakes; and (e) if a winner, by acceptance of prize, to use of name, voice, biography and likeness without further notice or compensation for promotion, advertising, filing and dissemination purposes, except in Tennessee and wherever else prohibited by law. Sponsor shall have the sole right to disqualify any contestant for violation of these rules or any applicable laws relating to the sweepstakes, and to resolve all disputes in their sole discretion. Companies (i) make no warranty, guaranty or representation of any kind concerning any prize, (ii) disclaim any implied warranty and (iii) are not liable for injuries, losses or damages arising out of any personÕs participation in the sweepstakes or the acceptance and use of any prize and travel thereto. Prize winners and travel companions (if applicable) will be required to sign and return an affidavit of eligibility and liability release and, where legal, a publicity release within seven (7) days of prize notification date or prize will be forfeited and awarded to an alternate winner. All disputes will be resolved under applicable U.S. laws. Prizes are not transferable. No substitutions or cash equivalents will be allowed except at the sole discretion of Companies.

 

Companies are not responsible for hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures or faulty transmissions or for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, or entry not received by Sponsor on account of technical problems or traffic congestion on the Internet, or at a Website, or any combination thereof. Companies further disclaim any responsibility for any injury or damage to entrant's or any other person's computer related to or resulting from entering the Contest or downloading any material for the Contest, or other telecommunications malfunctions which may limit an entrant's ability to participate. Sponsor may prohibit an entrant from participating in the Contest or winning a prize if, in its sole discretion, Sponsor determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrant or SponsorÕs representatives. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYSÕ FEES) FROM ANY SUCH ENTRANT OR PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

 

Sponsor reserves the right, in its sole discretion, to cancel or suspend the Sweepstakes for any reason. In the event of cancellation, Sponsor may elect to identify winners and award the prizes by way of random drawing from among all entrants who had entered the sweepstakes at the time of such cancellations.
